Terms of Service

Welcome to NexESG, an enterprise ESG data management platform operated by SomaTech ("we," "our," or "us"). By accessing or using the platform, you agree to be bound by these Terms of Service.

1. Enterprise Access & Accounts

Access to the NexESG platform is granted via secure Enterprise Access Keys provided to authorized organizations. The organization's Master Admin is responsible for maintaining the confidentiality of login credentials and managing the access rights of subsidiary and department users. You are responsible for all activities that occur under your organization's accounts.

2. Platform Usage & Restrictions

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code of the platform.
  • Use the platform to store or transmit malicious code, malware, or illegal content.
  • Attempt to bypass or circumvent the Row Level Security policies that keep each organisation's data separate.

3. Data Ownership

Your organization retains full ownership of all corporate data, ESG metrics, and documents uploaded to the platform. NexESG claims no ownership rights over your proprietary business data. You grant us a limited license to host, process, and display this data solely for the purpose of providing the service to you.

4. Service Availability & Support

We strive to ensure maximum uptime and reliability. However, the platform is provided "as is" and "as available." We reserve the right to perform scheduled maintenance, which will be communicated to Master Admins in advance.

5. Account Termination & Data Wiping

We reserve the right to suspend or revoke access for violations of these Terms or non-payment of subscription fees. Upon contract termination or explicit request, we provide a secure data wipe that permanently destroys your organisation's records.

A wipe covers the parent organisation and every subsidiary beneath it, and removes ESG entries and calculated results, uploaded evidence documents, brand assets, messages and voice recordings, review comments, audit records, user profiles and the associated login accounts.

A wipe takes effect immediately and cannot be undone. We do not hold a recovery copy and there is no restoration period, so please export any data you wish to keep before requesting one. If we introduce a restoration period in future, we will update these Terms and notify Master Admins before the change takes effect.
